Nerang First Nationals business is governed by the Property Agents and Motor Dealers Act of 2000 and Nerang First Nationals own policies and procedures.   • Establishment of rent payment services when you become a tenant

  • Contact of next-of-kins in an emergency situation

  • Research and development of new products or services

  •  Training and Quality Control

  • Positive identification and verification purposes when communicating with you over the telephone

  • Communication of a related company’s  or a third party’s  marketing offers to you and/or other parties nominated on forms completed by us for you

  • To meet our legal obligations, eg in accordance with legislation

What Information do we collect and how do we use it
Generally we collect personal information directly from you, such as when you apply for a service. We also access and or purchase information available on commercial databases which is used in the provision of our services, processing of tenancy applications or in the marketing of our services.

Personal Information can also be submitted on our web pages as follows:

  • You can subscribe to our weekly property newsletter by submitting your name and e-mail address.

  • You can subscribe to the property chat site by submitting your name and e-mail address.

  • You can request a market appraisal by completing an on-line form. Some personal information is required when submitting this request

  • You can request a variety of information by completing an on-line inquiry form. Some personal information is required when submitting this request.

  • When you request for service or information from our company we need to know your:

    • name;

    • address;

    • contact numbers;

    • email address

We also use the information we collect for purposes other than those specified above if:

  • you would reasonably expect us to use the personal information for that other purpose, and

  •  that other purpose is related to the purposes specified above, for example, to enable us to occasionally contact you about:

Information collected from visits to our Web Site
When you visit our site to view pages and/or download information, we record the following for our own troubleshooting, security, marketing and statistical purposes:

We use web server programs to collect the above information. The information we collect is used to create summary statistics which allows us to assess the number of visitors to the different sections of our site, discover what information is most and least used, determine technical design specifications, and help us make our site more useful to visitors.

Security of your Personal Information
We will take all reasonable precautions to ensure that all information we collect, use or disclose is accurate, up-to-date and stored in a secure environment and accessed only by authorised persons.

If you are a tenant and you default on your tenancy agreement then the information may also be disclosed to a Tenancy Database for use by any other member agent. When information is disclosed to any other party it is done in accordance with the provisions of the Privacy Act and other legislative requirements which may exist at the time.

If we wish to disclose any of this personal information, information or data other than as set out above, we will not do so unless we have your express consent to do so.

Direct Marketing
From time to time we use information supplied to us by commercial database companies for marketing our company services. This is done in accordance with the provisions of the Privacy Act 1988. Prospective clients and customers are given the opportunity to be excluded from any marketing activities and can elect not to receive specific and direct marketing communication from us.

You can Access, Correct or Update Your Information
You will always have access to the information and content that you provide to us. There are exceptions to this right and they include:

  • where providing access will pose a serious threat to life or health of any individual or pose an unreasonable impact on the privacy of an individual;

  • your request for access is frivolous or vexatious;

  • where the information relates to existing legal proceedings between Montar Pty Ltd and you and the information would not be discoverable in the process of those legal proceedings; or

  • where providing access would be unlawful, may prejudice an investigation of possible unlawful activity, may prejudice enforcement of laws, or denying access is specifically authorised by law.

If we do not allow you access to your personal information, we will endeavour to provide you with the reasons for our decision.

You can choose to modify or delete your personal information, unless it is mandatory information required for your membership. If you believe that the personal information we collected about you is inaccurate, incomplete, or not up-to-date please notify us immediately so that we may correct and/or update the information if necessary.

If for some reason you believe that Nerang First National has not adhered to these principles please notify us by e-mail at privacy@nfn.com.au and we will do our best to investigate and correct the problem.

Notification of changes to the Privacy Policy
If we decide to change our privacy policy, we will post those changes on our Website so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use Personally Identifiable Information in a manner different from that stated at the time it was collected, we will notify you by way of an email.
